1. Scope of application

Our General Conditions of Sale (GCS) apply to all orders and all deliveries between the company CHACALY SRL, Allée Saint-Martin 10, 1428 Lillois – Belgium (hereinafter referred to as CHACALY) and its customers of the online store www.sunandzaira.com, www.sunandzaira.fr, www.sunandzaira.be, www.sunandzaira.nl.

2. Order procedure, conclusion of contract, quantity limit

Order procedure

CHACALY offers its customers a wide choice of items for pets. The customer can access product details such as presentation, dimensions or taste by clicking on the products or article designations. When the customer selects the desired number of items and clicks on a button with a pictogram representing a shopping cart or with the words “Add to cart”, the product is placed in a virtual shopping cart.

When clicking on the “my cart” button in the online store, at the top right of the screen, the customer accesses a summary page and can check at any time which items are in his virtual basket and if necessary, make changes.

If the customer wishes to complete his purchases, he can continue the procedure by clicking on the button “Validation of the order”. Already registered customers can enter their username and password here to automatically use their saved information to place their order. The customer can also register as a new customer and create a customer account or continue shopping without using a customer account. In this case, the customer must enter his address and invoice information on the next page.

By clicking again on the “next” button, the customer reaches the penultimate step of the “Preview” order. The customer then obtains a statement of his order with the mention of the price (legal VAT included) as well as information on the service and delivery costs.

The order is completed as soon as the customer clicks on the “Order” button. A firm offer is then submitted.

Conclusion of the contract

The photographs of the product assortment in the online store are for viewing purposes only, they are in no way binding offers to purchase. As for the customer, he makes a firm offer to conclude a sales contract as soon as he completes the ordering process by clicking on the “Order” button. The customer then receives an automatic order acknowledgement by e-mail (order confirmation). This order confirmation does not yet constitute an acceptance of the offer. The contract with CHACALY is only concluded when CHACALY dispatches the ordered product to the customer and confirms the dispatch to the customer by e-mail (dispatch confirmation).

Quantity Limit

The sale of the products offered only concerns quantities compatible with individual private use and is only intended for adults.

3. Prices and shipping costs

Prices

All prices include the legally valid VAT and other price components; possible shipping costs are extra.

In case of obvious typographical error, leading to the display of a “vile price”, the sale may be cancelled.

Shipping Costs

  • The maximum amount of an order cannot exceed the sum of 1.900,00 EUR.
  • For any order amounting to 49 € (excluding discounts and promotions), shipping is free to Mondial Relay points in Belgium, France and Luxembourg. In case of an order of less than 49 €, shipping costs will be charged according to the details on our page Shipping costs.
  • Important :a package can contain a maximum of 31 kg of merchandise. Orders weighing more than this limit will be shipped in two or more packages. This is why, depending on the value and weight of your order, additional costs per additional parcel will be applied to the total of your order as soon as a second parcel for Belgium is sent. The total amount of the shipping costs will be indicated once you have identified yourself or when you have provided a mailing address when validating your order. If an order has to be delivered in several packages for other technical or logistical reasons, no additional shipping costs will be charged to the customer.

4. Shipping

CHACALY delivers only to consumers.

The delivery time is 7 working days unless a different delivery time is mentioned in the offer. Information on Fees and delivery times are available on this link.

If all the products ordered are not in stock, CHACALY is authorized to make partial deliveries at its own expense, if this is possible for the customer.

In the event that CHACALY is unable to deliver the product ordered because CHACALY is not delivered by its suppliers for reasons for which it cannot be held responsible, CHACALY may withdraw from this contract. In this case, CHACALY will immediately inform the customer and propose a comparable product. If no comparable product is available or if the customer does not wish this product to be delivered to him, CHACALY will immediately refund the amounts already paid.

On the territory of the European Union, the delivery is exempt from customs duties. For a delivery in a country outside the European Union, in particular in Switzerland, the customer will have to pay himself possible customs duties, taxes and other taxes.

CHACALY cannot be held responsible for any breakage or loss during transport as well as any delay in delivery. The products are packed in protections in order to protect them as well as possible.

If the items delivered have been damaged during transport, CHACALY’s customer service department must be informed as soon as possible. CHACALY will thus be able to address complaints to the carrier or to the transport insurance (if the customer wished to subscribe to this insurance). If the customer does not declare a transport damage, this negligence will not affect his legal warranty claims.

5. Retention of ownership

The products remain the property of CHACALY until full payment has been made. The products may not be pledged, given as security, transformed or modified prior to the transfer of ownership without the authorization of CHACALY.

6. Right of withdrawal

Customers are consumers and as such have a right of withdrawal of fourteen days. A “consumer” is any natural person who performs a legal act for a purpose which cannot be attributed either to his trade, business, craft or profession. The following regulations on the right of withdrawal and its exclusion apply. For any other question about the retraction, the customer can contact CHACALY’s customer service.

You have the right to withdraw from this contract without giving reasons within fourteen days. The withdrawal period expires fourteen days after the day “when you or a third party other than the carrier and designated by you, takes physical possession of the last good delivered of your order”.

To exercise the right of withdrawal, you must notify us (CHACALY, Allée Saint-Martin 10, 1428 Lillois – Belgium, [email protected]) of your decision to withdraw from this contract by means of an unambiguous statement (for example, letter sent by post or e-mail).
In order to comply with the withdrawal period, it is sufficient that you send your communication on the exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this Agreement, we will refund all payments received from you, including delivery charges (except for any additional charges arising from you choosing, where applicable, a method of delivery other than the cheaper standard method of delivery offered by us) without undue delay and in any event no later than fourteen days from the day we are informed of your decision to withdraw from this Agreement. We will issue a refund using the same payment method you used for the original transaction, unless you expressly agree to a different method, in which case there will be no charge to you. We may refuse to reimburse you before we have received the returned products or before you have provided proof that you have returned the products, taking as a reference, the earliest date.

You must return or hand over the products to us without undue delay and in any case no later than fourteen days from the date you informed us of your withdrawal, to the address below :

The deadline is deemed to have been met when you have sent us the products within fourteen days.

You shall only be liable for any loss of value of the goods if this loss of value is due to the fact that you have manipulated the product to check its condition, characteristics and functioning when this was not necessary.

Exclusion of the right of withdrawal

Any right of withdrawal is excluded for the delivery of products

  • which are not prefabricated and which are manufactured according to an individual choice or specification of the consumer or according to his personal needs, for the delivery of perishable products or products whose expiry date could be rapidly exceeded,
  • which cannot be returned for reasons of hygiene or health protection, if their hermetic seal has been removed after delivery,
  • if they have been inseparably mixed with other products due to their texture, after delivery.

7. Warranty and liability

Only the accessories and dog toys sold by CHACALY have a two-year warranty for lack of conformity of the good for two years from the moment of delivery of the product.

The Customer, in these terms, can demand the remediation when the acquired property is not in conformity with the contract, giving him the option to demand the repair or replacement of the property, unless they are impossible or disproportionate, in which case the Customer can demand the reduction of the price or the termination of the contract, within the legal framework of guarantee.

To be able to exercise this guarantee, the Customer must contact CHACALY by sending an e-mail to [email protected] where he will indicate :

The name of the order holder
Order number, and
The cause of the non-conformity of the product

Some warranty cases will not be accepted:

  • When the products have been used and/or handled in an improper and/or negligent manner or not in accordance with its characteristics
  • Resulting from misuse of the product or ordinary wear and tear from its use
  • If any of the information on the purchase receipt is altered, changed or replaced
  • Outside the established warranty periods

8. Methods of payment and credit notes

Methods of payment

Products can be paid by direct debit, bank transfer, credit card, Paypal or prepayment. CHACALY reserves the right to accept exclusively certain types of payment according to the order or the delivery method chosen by the customer. It is not possible to pay by sending cash or cheques.

Payment by credit / debit card

In the case of payment by credit or debit card, the amount is debited directly upon confirmation of the order. We accept payments by Visa, MasterCard, Bancontact, iDeal, PayPal.

Discount codes and gift codes

When using a discount code or gift code, the valid terms and conditions of use such as minimum order quantity, validity period etc. must be observed. The corresponding information is mentioned with the relevant code. In any case, only one code can be accepted per order and per customer. Cash payment and subsequent compensation with previous orders is not possible. It is forbidden to resell the codes.

9. Protection of computer data

CHACALY takes the protection of its customers’ computer data very seriously. You can read the data protection declaration here.

10. Internet risks

The customer is aware of the restrictions and risks associated with the use of the internet or any other means by which the website is currently or will be made available in the future. The customer is also aware of the risks of storing and transmitting information by digital or electronic means. The client accepts that CHACALY cannot be held responsible for any damage caused by the use of the CHACALY website or the internet, as a result of the above-mentioned risks. The customer agrees that electronic communications and backups may be used as evidence.

12. Final provisions

If one of the articles of these general terms and conditions of sale were to be invalid or declared void by a competent court, this would not affect the validity of the other articles of these general terms and conditions, which would remain in full force and effect. If any of the articles of these general terms and conditions were to be invalid or declared void by a competent court, the parties shall consult each other to replace that article with a valid article as close as possible to the original intention of the parties.

All contracts concluded between CHACALY and its customers and these general terms and conditions of sale are exclusively governed by Belgian law. Any dispute concerning the existence, execution and/or interpretation of these general conditions and all contracts concluded between CHACALY and its clients are subject to the exclusive power of the Court of Brussels.

13. Printed version of the GCS

The customer has the option of obtaining a printable version of these GCS. He can print them out or save them to his computer.
